La XXe EISC, qui s’est déroulée les 15 et 16 octobre au Sénat, a débouché sur l’adoption d’une résolution qui prône notamment l’adoption et la clarification des législations spatiales nationales.
C’était le dernier temps fort de la XXe European Interparliamentary Space Conference qui s’est tenue au Sénat. En fin de journée, le mardi 16 octobre, les membres de l’EISC (retour sur ces deux jours présidés parle Sénateur Yves Evrard par ici) ont adopté une résolution. Le texte, approuvé à l’unanimité, se compose de deux grandes parties.
Dans la première, l’EISC établit une série de considérants. Peuvent notamment être cités le fait que l’espace soit « un domaine-clef pour le progrès, le leadership et l’identité de l’Europe », ou encore la nécessité pour les Etats-membres de « coopérer afin de travailler plus efficacement pour assurer une utilisation durable de l’espace ».
La seconde moitié de la résolution est, par contre, consacrée aux souhaits et recommandations de l’EISC. S’y trouvent, par exemple, « le rôle du Big Data dans des domaines politiques spécifiques » ainsi que « les diverses problématiques de la chaine de valeur du Big Data ».
La « nécessité d’un développement coordonné du droit de l’espace national en Europe par les Etats-membres » est également pointée, de même que la demande faite aux parlements des Etats-membres « de soutenir l’adoption, les amendements et/ou la clarification de la législation spatiale nationale pour y incorporer des principes du droit spatial international et fournir un cadre sûr pour le développement d’activités spatiales privées ».

The European Interparliamentary Space Conference (EISC):
RECOGNISES that space is a key area for European leadership, progress and identity;
CONSIDERS that the Space Sector is a continuously changing environment towards the increase and variety of public and private space activities at national, intergovernmental and European level;
BELIEVES that Member States through the participation in EISC can significantly contribute and support the process and success of a European space endeavour;
RECOGNISES the need of Member States to cooperate in order to work efficiently towards ensuring a sustainable space use;
BELIEVES that Europe needs to be proactive in order remain competitive in the constant developments and changes of the space sector, by building and maintaining competencies through strong frameworks for cooperation;
TAKES INTO CONSIDERATION that space applications can provide more and more benefits for societies and solutions to various problems on earth;
The 20th European Interparliamentary Space Conference has agreed on:
APPRECIATES ESA’s Digital Agenda for Space;
CONSIDERS the role of Big Data in specific policy areas;
CONSIDERS the various issues for the big data value chain;
CONSIDERS the various legal issues related to regulation of big data from space activities;
IDENTIFIES the need for coordinated development of national space law in Europe by Member States;
CALLS national parliaments to support the adoption, amendments and/or clarification of national space legislation to incorporate principles of international space law and provide a secure framework for development of private space activities;
ENCOURAGES space industry to adapt to Industry 4.0 and Space 4.0;
CONSIDERS the potential for development and the risks of a European approach to innovation in space and through space technology and applications;
EMPHASISES the need for deficiencies to be covered in the legal framework for space, as private enterprise necessitates legal certainty and clear legal framework;
CALLS Member States to identify ways in which space use can be beneficial for life on earth in order to spread the benefits of space use in a coordinated and sustainable manner;
HIHGLIGHTS the new opportunities for entrepreneurship in various sectors in space or on earth, supported by space tools, including developments related to cyberspace;
RECOGNISES the importance of space in safety and security where cybersecurity is an underlining element that needs further attention for future activities;
CALLS for the space actors to work together on alternative financing to support entrepreneurs, SMEs and companies engaged in the space sector to maintain a European competitive sector with sustainable growth;
RECOGNISES the need for coordination between actors in the space sector and Member States in UNCOPUOS to make Europe leader for global benefit;
IDENTIFIES the need for clear distribution of roles and mandates between space-related institutions in public and private sector in Europe towards an efficient and beneficial cooperation, avoiding duplication of efforts for the development of the European space sector;
INVITES national parliaments to actively promote cooperation in space at European and international level.
